EMS & THE LAW

Abandonment
Leaving the patient before completing care or transferring care to someone who has less training.
Actual Consent
Consent given by a rational Adult, usually in oral form, accepting emergency Care.
Advanced Directives
Written documentation that specifies Medical treatment wishes for a competent patient if that person should become unable to make decisions.
DNR (Do Not Resuscitate)
Written Documentation giving permission to medical personnel Not to attempt Resuscitation in the event of Cardiac arrest.
Duty To Act
Individual responsibility to attempt to help someone in an emergency. (Check Your State Laws.)
Good Samaritan Law
A series of laws Varying in each state, designed to provide limited legal protection for citizens and some health care workers when they are administering emergency Care.
Implied Consent

Legal concept that assumes an unconscious patient(Or someone so badly injured or ill that they cannot respond.) would consent to receive if they could do so.

MAY apply to children or mentally or emotionally disturbed individuals when parents or guardian is not around.

Medical Direction

Physicians Instructions that are given directly by Radio or telephone (On line/ direct) .

OR

By Protocol / guidelines Off line and indirect as authorized by a medical director.

Negligence
Failure to provide the expected standard of care, Leading to injury or death of a patient.
Protocols
List of steps, such as assessment, and steps and interventions to be preformed in different situations.
Quality Improvement
A system of continually evaluating and improving the care provided in an EMS system.
Standard Of Care
The minimum acceptable level of care based on what is expected of someone with your training and experience acting in the same or similar situation.
